General conditions regarding Internet sales
These general terms and conditions govern sales on the Thés de la Pagode website: thesdelapagode.com (hereafter referred to as “site”). These conditions apply to the exclusion of all other conditions, especially those proposed by distributors, for conventional mail-order sales from catalogues, promotional mails and press announcements. The placing and subsequent validation of an order on the Thés de la Pagode site fully binds the purchaser to these general conditions of sale, without any reservation. Any contrary condition imposed by the buyer will therefore, in the absence of prior and express acceptance by Thés de la Pagode, be unenforceable, regardless of when it may have been brought to his attention.
The fact that Thés de la Pagode does not avail itself at any time of any of the present general conditions of sale, cannot be interpreted as subsequently renouncing to avail itself of any of the said terms and conditions.

The intellectual property rights for the products and documents on the website and each of the elements created for this site belong exclusively to Thés de la Pagode, who concedes no licence and no right other than to consult the website.

The trademarks and other intellectual property rights referred on the site belong to Thés de la Pagode. In particular, Thés de la Pagode is a protected trade mark.

The reproduction of trade marks, distinctive signs, products and generally all documents published on the website is prohibited. By way of derogation, the reproduction of any document published on the Website is authorised solely for the exclusive purposes of information for personal and private use, any reproduction or use of copies made for other purposes being expressly prohibited.
Any reproduction or other use without the prior express consent of Thés de la Pagode will constitute infringement and will be prosecuted and sanctioned under the intellectual property Code.


Offers and prices 
The offers and prices offered on the Thés de la Pagode website may be exclusive and different from offers proposed by our shops, mail order offers in catalogues, promotional mail shots and announcements in the Thés de la Pagode press. Some offers available in shops, catalogues, mail shots or press announcements may not be available from the Internet site.
The prices of our products are given in Euros, including tax within the European Union and excluding tax outside the European Union. In addition to the cost of the products, you will be asked to pay carriage, packaging and order processing costs, based on a current tariff.
Offers and prices are subject to change throughout the year. Ordered products are, of course, invoiced at the current price (as displayed on the website) in force when the purchaser submits his order.
Promotional offers are valid outside mainland France for the period specified, as displayed on the site, and whilst stocks last. Products sold in batches can be purchased individually.
Orders can only be accepted if the prices listed comply with those of the current offer.


From placing the order to confirming the transaction

Place your order according to the steps outlined below:

This contains details of the products you have ordered and gifts available when you placed the order To shop, either:


Access the detailed sheet for the product you have selected via the "Discover" button, select the desired quantity and click on the "ORDER" button. 

Click directly on "Purchase" on the full product list


Regardless of your choice, you can then access your basket:


- either directly via the pop-up which is displayed when you add a product to your order (by clicking on “Order”)

- or by clicking on the "Basket" in the top right-hand corner of the homepage


Click "Next" to go to the next stage.

Identify yourself by entering your e-mail address and pass word and then clicking on "Identify you".

Create a new account by entering your e-mail address in the "Is this your first order?" area and then clicking on "Create your account".



If you have already ordered from our website, you can identify yourself by entering your e-mail address in the box provided by clicking on "My account" and your details will automatically be displayed once your e-mail address has been completed and validated by clicking on the "Identify you" button. Click "validate" to go to the next stage


Creation of a client account

If you do not have a client account on our website, you must create one in order to place an order. Enter your personal details (first name, name and e-mail address are required to place an order) and enter your password. Click on "Register" to go to the next stage. Then enter your delivery address (name, first name, address, post code, city, country and a telephone number are required to place an order), then click on "Register".


Step 1: Summary of your order

At this stage, you can change your order, add or delete products. Click "Next" to go to the next stage.


Step 2: Identification/Creation of customer account

If you are not already connected to your customer account, you can either create your account (see "Create a customer account" section), identify yourself by entering your e-mail address and password, and then click on "Identify you" (see "Identification" section).


Step 3: Address

At this point you can enter your delivery and invoice address (which can be the same or different depending on your preference). You can either select an address that is already registered in your account or update an address or add a new address. To add a new address, click on "Add a new address" and complete the obligatory fields (first name, name, address, post code, city, country and telephone number are required to place an order). Click "Next" to go to the next stage".


Step 4: Delivery

Select your delivery method (Post, 10 to 15 working days outside mainland France)). You can consult the general terms and conditions of sale on this page. You must tick the box accepting the general terms and conditions of sale to go to the next stage.


Step 5: Payment

At this point you can chose to pay directly on-line by bank card, via a secure payment system by clicking the "Pay by bank card" button. If you choose this option, you will be directed to our bank's secure site.


Confirmation of your order
Once your order has been validated, you will receive an e-mail confirming your order. This e-mail will include your personal details, details of your order, the cost and delivery address. 

Our order registering system will confirm the date and description of your order subject to subsequent checking by us that the order is consistent with the offer available at the time you place your order. Once the order has been validated and your payment taken, neither you nor our customer services department can amend your order or apply any promotional offers.


Payment methods
Use the Thés de la Pagode website to place and validate your order on line and pay with your bank card. Payment is made directly on-line to our bank (Caisse d'Epargne Ile-de-France) via a secure transaction using the SPPLUS system equipped with 3D Secure. 
Payment details are entered in encrypted format using the SSL128 bit protocol (Secure Socket Layer) - the most widely used payment method.

When you order on-line, your bank card is debited immediately according to the procedure outlined below.




Confirmation of order and product availability 
Once your order has been validated, you will receive an e-mail confirming your order.

If the goods are currently out of stock, we reserve the right to wait for new stock to arrive before completing your order. A provisional dispatch date will be given on the confirmation e-mail. If you wish, you may decide to cancel your order by contacting the Customer Services Department by e-mail or telephone on +33 (0)1.4804.5407. If new supplies take longer to arrive, an initial package will be dispatched as soon as possible with the products available. Thés de la Pagode will dispatch the other products at its own cost. You will be informed of this in the confirmation e-mail. If you wish, you may cancel the dispatch of the remaining order by contacting the Customer Services Department by e-mail or phone on +33 (0)1 4804 5407.


Product delivery
Thés de la Pagode shall undertake to deliver the items ordered on-line as quickly as possible.
You will receive your package within 10 to 15 working days, on average.
If your goods cannot be delivered by the maximum delivery date stipulated, you can cancel your order without incurring any cost, in accordance with the Chatel legislation (French law to protect consumers' rights).


Orders delivered outside the European Union
In the case of an order delivered outside the European Union, the purchaser is considered to have imported the product(s) in question The purchaser is responsible for contacting the local authorities to establish whether he is liable for any customs duties, local taxes and import duties. Thés de la Pagode accepts no responsibility for this.

The products marketed by  www.thesdelapagode.com comply with French legislation. The purchaser is responsible for finding out from the local authorities if any limitations apply to the importing and use of the products ordered.

Thés de la Pagode accepts no liability for the purchase of a product deemed to be non-compliant in a given country when this product complies with French legislation.


Fixed fee
A fixed fee to cover carriage, packaging and order processing costs is applied to each order. The fixed fee is invoiced according to zone (valid for main offers accessible on-line, excluding specific orders accessible via promotional codes in advertisements or e-mails):

All of our goods are dispatched by a standard postal delivery.

The default setting on your basket is set for deliveries to mainland France. If you select another country for delivery, your basket will be automatically updated with the fixed fee corresponding to your chosen country of destination. 

This fee is currently set by Thés de la Pagode depending on the amount spent on the main products accessed via the website. It does not include specific offers to be delivered only to mainland France and accessible via promotional codes, advertisements or e-mails.
Information regarding the fixed fee and the level required to benefit from delivery offers are displayed automatically in the basket (bottom right), depending on your chosen delivery destination. 
If you have not reached this required level, information on your fixed fee will be automatically displayed in your basket (bottom right), depending on your chosen delivery destination.


Cancellation period, Satisfaction or Money Back Guarantee
Our products are produced and checked with the utmost care and attention to detail. This means they are guaranteed and we are committed to refunding or replacing them if you are not entirely satisfied with your purchase. You have 30 days from the date of receipt to return your goods to us and receive an automatic refund to your customer account.

The following procedure applies when a customer returns an item that has been paid for and requests a refund:
- The package is returned unopened: we will refund any packaging and delivery costs.
- The product is returned in its original packaging by you: we will refund the cost of the product but you will incur the return costs.
- We are responsible for the return of the product: we will refund the cost of the product and any delivery and return costs.

Thés de la Pagode is not liable for failing to implement an agreement in the case of force majeure, disruption or total or partial strike action involving postal services and transport and/or communication networks.

Changes to general terms and conditions of sale
Thés de la Pagode reserves the right to adapt or amend the current general terms and conditions at any time. Customers will be informed of the new general terms and conditions relating to on-line sales. These changes will apply only to those purchases paid for after the amendment was made.


Applicable rights 
This contract is subject to French legislation. This contract is written in English. In the event of a dispute, the Paris Court is the competent body.
